By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services. If using on behalf of an entity, you represent authority to bind it. These Terms form a legal agreement; read them carefully.

We may update these Terms from time to time. We will notify you of material changes via email, in-app notice, or posting on the Services. Continued use constitutes acceptance. For minor changes, no advance notice may be provided.

Eligibility and Account Registration

Age and Location

You must be at least 18 years old (or the age of majority in your jurisdiction) and located in the US to use the Services. If 13-17, you may use only with parent/guardian consent and supervision. The Services are not for children under 13; we do not knowingly collect their data.

Compliance

Your use must comply with all applicable laws. Professionals must hold required licenses/qualifications.

Account Creation

Provide accurate, current information. Update as needed. You are responsible for account security; notify us at contact@houseescort.com of unauthorized access. Do not create multiple accounts or transfer without consent. We may verify identities via background checks (with consent for Professionals).

User Roles

Users post jobs, hire, pay, review. Professionals profile, apply, provide services, receive payments.

Services Description and Limitations

House Escort is a platform facilitator only. We do not provide, sell, or subcontract services; any agreement is between Users and Professionals. We do not employ Professionals or guarantee their availability, suitability, quality, timeliness, or legality. Scheduling, fulfillment, and disputes are between you and the other party.

We may offer tools like chat, payments, reviews, but we do not endorse or verify content beyond basic moderation. Background checks are limited; results are not guarantees of safety or competence.

User Conduct and Prohibited Activities

You agree to use the Services professionally and lawfully. Prohibited activities include, but are not limited to:

Fraud, misrepresentation (e.g., false profiles, credentials, reviews).
Harassment, abuse, threats, hate speech, discrimination, stalking.
Illegal content or activities (e.g., promoting unlawful services, pyramid schemes).
Posting obscene, defamatory, infringing, or harmful content.
Spamming, unsolicited messages, viruses, malicious code.
Interfering with operations (e.g., hacking, overloading, scraping without permission).
Circumventing the platform (e.g., off-platform dealings to avoid fees, soliciting outside hires).
Impersonation, unauthorized access.
Violating third-party rights (e.g., IP infringement).
Failing to perform agreed services or pay for them.
Undermining reviews or engaging in fake transactions.
Any other conduct that harms the Services, users, or our reputation.

We may monitor communications/content for compliance. Violations may result in warnings, suspensions, terminations, content removal, or reporting to authorities. You are solely responsible for your interactions and content.

Payments, Subscriptions, and Refunds

Payments: Facilitated via Stripe; we deduct commissions. You authorize charges. Disputes between Users/Professionals must be resolved independently; we may assist but are not obligated.
Subscriptions: Professionals may require subscriptions to access features (pricing displayed in Services; auto-renew until canceled via settings).
Refunds/Cancellations: Non-refundable except as required by law or our discretion. For services, policies are between parties; we do not guarantee refunds.
Taxes: You are responsible for applicable taxes.

Content Ownership and Licenses

You retain ownership of your content but grant us a perpetual, royalty-free, worldwide license to use, store, display, reproduce, modify, and distribute it for operating the Services. We own all our IP (e.g., logos, software); you get a limited license to use the Services.

We may moderate/remove content asynchronously. Public content (e.g., reviews) is visible and not private.

Disclaimers and No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DISCLAIM LIABILITY FOR:

Service quality, outcomes, injuries, property damage, or losses from Professional services.
User conduct, interactions, or disputes.
Payments not honored, fraud, or financial losses between users.
Content accuracy, legality, or offensiveness.
Interruptions, errors, viruses, or data loss.
Reliance on advice, tips, or information in the Services.

USE AT YOUR OWN RISK. WE DO NOT GUARANTEE RESULTS, SAFETY, OR COMPATIBILITY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE ESCORT, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, GOODWILL, EMOTIONAL DISTRESS, PERSONAL INJURY, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID US IN THE PRIOR 6 MONTHS OR $100, WHICHEVER IS GREATER.

THESE LIMITATIONS APPLY REGARDLESS OF LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, ETC.) AND SURVIVE TERMINATION. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIMITATIONS, SO THEY APPLY ONLY AS PERMITTED.

Indemnification

You agree to indemnify, defend, and hold harmless House Escort, its affiliates, officers, directors, employees, agents, and partners from any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of the Services; your content, communications, or interactions; your provision or receipt of services (including injuries, damages, or disputes); violations of these Terms, laws, or third-party rights; or any negligence or willful misconduct. We may assume control of defense; you must cooperate. This includes waivers of unknown claims (e.g., California Civil Code §1542). This section survives termination.

Termination and Suspension

We may suspend, terminate, or restrict your access at any time, with or without notice or cause, including for violations, inactivity, or operational reasons. Upon termination, you lose access, no refunds are issued, and content may be deleted (though public content may persist). You may deactivate your account via settings, but obligations survive (e.g., indemnification, limitations).

Dispute Resolution and Governing Law

Informal Resolution

For disputes with us, first contact us at legal@houseescort.com with details; we will attempt good faith resolution within 60 days.

Binding Arbitration

Any unresolved disputes arising from these Terms or the Services shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration is individual; no class actions, class arbitrations, or representative actions are permitted—you waive these rights. The arbitrator's decision is final and binding, enforceable in court. Costs are shared per AAA rules; small claims court is an alternative for qualifying claims. IP disputes or injunctive relief may be litigated.

Opt-Out

You may opt out of arbitration within 30 days of first use by emailing legal@houseescort.com with your details.

Governing Law

These Terms are governed by Wyoming law, without conflicts principles. Non-arbitrable disputes shall be resolved in state or federal courts in Sheridan, Wyoming; you consent to jurisdiction and waive venue objections.

Time Limit

Claims must be brought within one year of accrual.

Miscellaneous

Force Majeure: No liability for delays due to events beyond control (e.g., natural disasters, wars, strikes—except payment obligations).
Entire Agreement: These Terms, Privacy Policy, and any incorporated policies supersede prior agreements.
Severability: Invalid provisions are severed; the rest remain enforceable.
No Waiver: Failure to enforce does not waive rights.
Assignment: We may assign these Terms; you may not without consent.
Third-Party Beneficiaries: None, except as specified.
Electronic Communications: You consent to electronic notices.
